These Terms of Service ("Terms") govern your use of Faxly, a cloud fax platform operated by Megawit, Inc. ("Company", "we", "us", or "our"). By accessing or using the Service you agree to be bound by these Terms.
By creating an account or using Faxly you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a company or organization you represent that you have authority to bind that entity to these Terms.
Faxly, operated by Megawit, Inc., provides a cloud-based fax transmission service that allows users to send and receive fax documents via the internet. The Service is provided on a subscription basis with plans described on our pricing page.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access to your account.

Paid plans are billed on a monthly basis. Subscription fees are charged in advance. All prices are in US Dollars. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months.
Payment is processed securely by Stripe. We do not store your full card details on our servers.
We strive for high availability but do not guarantee uninterrupted access to the Service. Fax delivery depends on third-party providers and recipient fax equipment and is not guaranteed. We are not liable for failed transmissions beyond our reasonable control.
You retain all rights to the documents you transmit through Faxly. You grant us a limited license to process and transmit your documents solely to provide the Service. See our Privacy Policy for details on how we handle your data.
The Faxly name, logo, software, and website design are our intellectual property. You may not copy, modify, or distribute them without our written permission.
The Service is provided "as is" without warranty of any kind. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Faxly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
These Terms are governed by the laws of the State of Delaware, United States, where Megawit, Inc. is incorporated, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction.
We may update these Terms at any time. Material changes will be communicated via email or prominent notice on our website at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.
